The Court of Appeal (Civil Division) handed down judgment in the case of Secretary of State for Work & Pensions v Lassal [2009] EWCA Civ 157 on 10th March 2009. The case concerned the interpretation of Directive 2004/38/EC (as implemented by the Immigration (European Economic Area) Regulations 2006 I 2006/1003) in a case where a French national had made a claim for income support. In the light of differing submissions by the parties on the Directive’s effect, the Court of Appeal referred the matter to the European Court of Justice for guidance.
