Legal Professional Privilege

The House of Lords issued judgment in the case of In re McE 12/03/2009 Times Law Reports on 11th March 2009. The case concerned the interaction of the Regulation of Investigatory Powers Act 2000 c. 23 with the right of legal professional privilege. A number of clients in Northern Ireland believed their conversations with their lawyers had been subject to surveillance. In a majority judgment, the Lords held that the Act allowed the secret monitoring of privileged client/solicitor discussions. In addition any other statutory rights of those held in custody were subject to the powers under the Act.
