The Court of Appeal issued judgment in Doran v Liverpool City Council [2009] EWCA Civ 146 on 3rd March 2009. This case concerned the powers of the local council to remove a family of Irish Travellers from a local authority site for alleged breaches of their licence agreement. and service of the notice to quit. On the family’s appeal against summary judgment in the lower court, the Court reviewed the recent legislative and case law developments in the area together with the effects of the Human Rights Act 1998 c. 42. Having decided in the Council’s favour, the Court dismissed the family’s appeal and issued practical guidance for future similar cases.
