Housing of vulnerable teenager
The House of Lords handed down judgment in the case of R (G) v London Borough of Southwark [2009] UKHL 26 on 20th May 2009. The case involved the council’s duties towards a 17 old boy and the interpretation of section 20 of the Children Act 1989 c. 41 with other statutory duties such as the Housing Act 1996 c. 52.
The House discussed earlier case law including the case of R (G) v Barnet London Borough Council [2004] 2 AC 208 and stated the 1989 Act took primacy over the 1996 Act for providing for children in need. Having applied the list of questions relevant to section 20 detailed in R (A) v Croydon London Borough Council [2008] EWCA Civ 1445, the appeal was allowed.
