Legislation Information Page
As with all JustCite Information Pages, there are several different Views available via the navigation links on the left-hand side of the screen. The default view is Overview and Citations.
Overview & Citations
This view provides a summary of the information JustCite holds about the case, including:
- Reference - This is the Statutory Reference for the legislation, comprising a year and chapter number.
- Status - This is an indication of whether or not the legislation has been repealed. If it has been repealed that will be indicated in capital letters. If it has not been repealed then it will prompt you to look at the Amending Items to see whether or not it has been changed in any way since it was passed.
You may also need to check Amendments made to the Whole Act record to see if any changes are listed there.
- Recent Citing Cases – These are the three most recent cases which add something to the learning on the instant provision.
- Recent Articles - These are the three most recent articles mentioning the legislation.
Viewing the full text
On the right of the screen is a list of providers offering the full text of the provision. Because JustCite offers only the year and chapter number as a citation for a legislative provision there is no list of parallel citations to expand first as there is on the Case Information Page.
Although JustCite does support searching by regnal year, a provision’s regnal year will not appear in the list of citations.
To view the full text of the provision select the third party database of your choice from the list. The full text of the document will open in a new window via the selected service.
Some full-text providers provide legislation “as enacted”, and some provide “consolidated” legislation. Legislation “as enacted” is legislation as it appeared on the day it received the royal assent. “Consolidated” legislation is legislation as it has effect today i.e. with all in-force amendments applied to the text. Which you will require depends on whether you need to know how the provision applies today or at some point in the past.
Some of the third party destinations JustCite uses are subscription-based, so you may need to enter a username and password for access. Once you have logged in to the service successfully, you will be taken straight to the text of the document.
The list of full-text providers can be customised so that services to which your organisation does not subscribe are greyed out.
Citing Cases
This view lists all of the cases that add to the learning on the instant provision. This can help to determine how a particular piece of legislation has been interpreted in court. This view provides the following information:
- In which court the instant provision was cited
- Title of the case
- Most authoritative citation for that case
- Key words or phrases that summarise the case
The Citing Cases section is tightly controlled by the Justis Editorial team. Cases which simply mention the provision in passing without adding anything to its interpretation or application will not be included.
Amended Items
This view details any previous legislation affected by the instant provision, including any amendments, repeals or express savings made by the instant provision. An explanation of the different terms used to describe the relationships between pieces of legislation can be found by clicking on the link labelled List of Abbreviations Used. Each entry provides the following information:
- Title of the Act / Statutory Instrument
- Statutory reference including section number
- Nature of the relationship such as am for amended or rep for repealed.
Amending Items
This view details any subsequent legislation affecting the instant provision, including any amendments to or repeals or express savings of the instant provision.
